DS 3 Terms & Conditions

National Payments Corporation of India (NPCI), an umbrella entity for operating retail payment systems in India, supports the industry initiative created and managed by a consortium of payment system operators and participants (banks & non-banks) in contribution of digital payments growth and boosting Indian payments industry. In furtherance of this objective, it hereby provides access to institutions and individuals to a 24*7 helpline i.e. DigiSaathi (“Platform”) created by the various payment industry participants (banks & non-banks), and NPCI shall lead and manage this Platform designed to provide information of digital payment products and services in India for and on behalf of such payment industry participants, being an industry participant itself.

These terms and conditions (Terms) govern the access and the use of the Data contained therein.

By accepting these Terms, you confirm you have read, understood and agreed with its contents.

The terms “User“, “you“, “your” hereunder refer to the person accessing or using the Platform. The terms “we“, “us“, “our” refer to NPCI.

You should also review our Privacy Policy. The Privacy Policy describes how we collect and handle any information gathered from users. By accessing or using the Platform, you accept the terms and expressly consent to the collection, use, storage, processing, and disclosure of your information in accordance with our Privacy Policy.

• OVERVIEW OF THE PLATFORM

1. The Platform is set up, operated, and maintained by NPCI on behalf of a consortium of payment system operators and participants (banks & non-banks) with the objective of contribution of digital payments growth and boosting Indian payments industry.
2. The Platform shall comprise of Digisaathi website, IVR toll free phone number, chatbot, call center, WhatsApp and other social media services, that may be amended from time to time at the sole discretion of NPCI, wherein User can ask some questions, most relevant and appropriate information towards which shall be provided to User on best effort basis.
3. To the fullest extent permitted by law, NPCI does not make any warranties of fitness for a particular purpose, title, merchantability, completeness, comprehensiveness, availability, security, compatibility or non-infringement; or that the Platform will be uninterrupted, free of viruses and other harmful components, accurate, error free or reliable.
4. Further use of Platform after amendments in the Terms, shall constitute the consent to accept these modifications. Refusal to accept these modifications shall preclude the User from using the Platform.
   
   

• ACCESS AND USE OF PLATFORM

1. User may access and use the Platform only for lawful, authorized purposes and shall not misuse the Platform and any information provided in connection with it in any manner whatsoever.
   
   

• By accessing the Platform, User agrees to the following code of conduct:

1. User is responsible for ensuring that the networks you use to access Service are secure and will not hold Service Provider responsible for any consequences of using the Service on an unsecure network.
2. User will not upload, publish, display or use (hereinafter “post”) content that:
   • is defamatory, racist, obscene, pornographic, paedophilic, invasive of another’s privacy, including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;
   • belongs to another person and to which the User does not have any right;
   • is harmful to child;
   • infringes any patent, trademark, copyright or other proprietary rights;
   • violates any law for the time being in force;
   • deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
   • impersonates another person;
   • threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting other nation;
   • contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
   • is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.
3. User will not state or suggest that any statements that User makes are endorsed by us without specific prior written consent.
4. User shall not modify, adapt or hack the information provided to the User on the Platform, or otherwise attempt to gain unauthorized access to the Platform or its related systems or networks.
5. User will not remove any copyright, trademark or other proprietary rights notices displayed on the Platform.
6. User will not post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.
7. User will not forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Platform.
8. User shall comply with any codes of conduct, policies, storage limitations, or other notices NPCI provides or publishes in connection with the Platform from time to time, and User shall promptly notify NPCI if the User learns of a security breach related to the Platform.
9. NPCI may record the calls of the User for quality and assurance purposes and may be not used otherwise.

• THIRD PARTY LINKS

1. We may allow the User to link or we may link the User ourselves with other third party content and services, in which case User may be subject to third party terms of service and/or privacy policies, through User’s use of the Platform. User acknowledges and agrees that we are not responsible for the availability of such external sites or resources, and do not endorse and are not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. User assumes all risk and we disclaim all liability arising from User’s use of any third party websites or applications.
2. User may incur third party fees through the use of the Platform. User acknowledges and agrees that User is are solely responsible for all such fees incurred by the User and User agrees to pay all such fees and abide by all such third party terms of service and/or privacy policies.
3. In addition, third party services may be accessed from, displayed on, or linked to a User’s device are not available in all languages or in all countries. NPCI makes no representation that the Platform, any third party services are appropriate or available for use in any particular location. To the extent a User chooses to access such services or materials, the User does so at your own initiative and are responsible for compliance with any and all applicable laws or agreements regarding such services or materials.

• DATA MADE AVAILABLE ON THE PLATFORM.

The following data may be available in the form of information through the Platform subject to the provisions of these Terms:

1. General information of digital payments products and services
2. Information on how to avail, use, etc. the product & services
3. Contact details of payment system operators and participants (banks and non-banks) for various purposes (including complaint redressal), to the extent available.
4. Other banking products and service related information,
   etc.

• The User shall not alter or modify the data in any manner and shall in no event monetize or sell the data or use it for any commercial purposes. The User shall store the data in India at all times and shall not take the data outside India under any circumstances.
  
  

• INTELLECTUAL PROPERTY RIGHTS

1. The User shall not use the names, trademarks and/or tradenames associated with NPCI in any manner whatsoever in the course of accessing and using the NPCI Data.
2. The User agrees not to make intellectual property claims on the Platform and not to use intellectual property protection such that it would prevent or block access to further use of any element of the Platform.
   
   

• DISRUPTION`

• NPCI makes no guarantee as to availability, quality or service levels of the access to the Platform available on a 24×7 basis or promise uninterrupted access. However, disruption of services may arise due to technical or operational difficulties, and no prior notice of downtime will be given to you in such circumstance. NPCI may also suspend the access of the Platform for specific User permanently or temporarily for any reason whatsoever, including while investigating complaints or alleged violations of these Terms, or disable access to the Platform for such User.
  
  

• LIMITATION OF LIABILITY

• NPCI shall not be liable for any loss or damage, including without limitation damages for loss of profit arising in contract, tort or otherwise from the use of or inability to use the Platform, including but not limited to indirect, incidental, special, punitive or consequential damages, from the User’s use or inability to use the Platform or any content or information or from any action taken (or refrained from being taken) as a result of using the Platform or any content or NPCI Data, regardless of whether NPCI has been notified of such loss or damage.
  
  

• INDEMNITY

• The User agrees to indemnify and hold harmless NPCI, its subsidiaries, affiliates, officers, directors, agents, and third parties, for any losses, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of its use of the Platform and/or arising from a breach of these Terms and/or any fraudulent act on its part.
  
  

• TERMINATION

• Any violation or breach of the Terms may lead to automatic suspension or termination of your access to the Platform, and we shall not be responsible or liable for any damages in this regard.
  
  

• GOVERNING LAW AND DISPUTE RESOLUTION

• These Terms shall be governed and construed in accordance with the laws of India and any disputes or proceedings arising hereunder shall be subject to the exclusive jurisdiction of the courts located in Mumbai.
  
  

• GRIEVANCE REDRESSAL

• Any complaints or concerns with regards to content of the Platform or comment or breach of these Terms shall be communicated to the Grievance Officer at the co-ordinates mentioned below in writing:
